Q. If I am injured, who will pay the compensation?
A. The person who injured you – most often, their insurer will write your cheque
Q. What happens if I am injured by someone who is not insured?
A. The MIB (Motor Insurers Bureau) pays compensation to road accident victims. The CICA (Criminal Injuries Compensation Authority) pay compensation to victims of a violent crime.
Q. What can I claim for?
A. Compensation for pain, suffering, inconvenience, loss of earnings, medical expenses, replacement car hire, the cost of vehicle repairs or replacement. Basically any reasonable losses you incur as a result of the accident.
Q. How do I start my claim?
A. Start by instructing Bradin Trubshaw Solicitors to act on your behalf. Remember – your opponents insurance company is not a charity, they will not want to pay you compensation if they can avoid it. If the insurance company resist your claim, we will advise you whether your matter can be taken to Court.
Q. The insurance company have already offered me some compensation, should I accept it?
A. NO. The insurance company would not be offering something to you unless they benefit from it. The amount offered is likely to be far less than what you are legally entitled to.
Q. What about “Claims Services”?
A. Unless they are lawyers – you will have to pay the claims service out of your damages. They are not monitored by a governing body, there is no restriction as to what they can take out of your compensation.
Q. But won’t I have to pay a Lawyer?
A. Yes, but lawyers can get most of your fees back from your opponents.
Q. What does “No Win, No Fee” mean?
A. You only have to pay your lawyer if you win.
