A Will - The most important document you will ever make...

A Will is probably one of the most important documents you will ever make in your life. Making a Will is the only way to ensure your property and possessions will go where you want after your death.

We will advise you upon many important matters that would need to be included in your Will, such as appointment of Executors who would ensure that your wishes are carried out, the appointment of Guardians for children under the age of 18 and the creation of trusts. We are able to advise you how you can reduce the tax your Estate will suffer by careful drafting of the terms of the Will.

There are number of points you should consider if you believe you do not need to make a will:

  • If you die without making a Will, your belongings will not necessarily go to your wife or husband. The Law decides how much should go to each of your relatives.
  • If you die without making a Will and have no family, everything goes to the Government.
  • A Will is essential to provide properly for young children in the event of both parents dying.
  • You and your partner should each have your own separate Will.
  • If you have married, separated, divorced or remarried since you made your Will, it is essential to make a new Will.
  • When you marry, any Will you may have already made is normally null and void.

 


 

Once you have made your Will, you should look at it every year to make sure it still fits your wishes and circumstances.

You should seek professional advice when you make or change your Will. Home made Wills may be incorrectly drawn up and executed and so may not stand up in Law.

Everyone should also consider making an Enduring Power of Attorney. This is a document that will give someone you trust the authority to look after your affairs if you are unable to do so. This could be for example, due to sickness or an accident. A Power of Attorney can be prepared immediately and should always be considered if you are intending to go abroad and, for example, you have property abroad and you wish someone to deal with this on your behalf.
